Right of withdrawal

Introduction

Consumers have the right to withdraw from this contract under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

Right of Withdrawal

You have the right to withdraw from this contract within 30 days without giving any reason.
The withdrawal period is 30 days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the last item.

To exercise your right of withdrawal, you must inform us, MS SPIRIT HANDELS GmbH & Co. KG, Tel.: +43 1 3480370, E-Mail: info@nebelkind.com, by means of a declaration of intent (e.g., a letter sent by post or an email) about your decision to withdraw from this contract. You may use the model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the date on which we received your withdrawal notice.

For this refund, we will use the same payment method that you used for the original transaction unless expressly agreed otherwise; in no case will you be charged any fees for this refund. We may withhold the refund until we have received the returned goods or until you have provided proof that you have sent back the goods, whichever is earlier.

You must return or hand over the goods without undue delay and in any case no later than fourteen days from the day you informed us about the withdrawal.

The deadline is met if you send the goods before the fourteen-day period expires.

We will cover the costs of returning the goods. However, we will either send you a return shipping label or reimburse the shipping costs you paid. The decision on whether a shipping label is provided or the postage is reimbursed lies with us.

You are only liable for any loss in value of the goods if this loss is due to handling that is not necessary for checking the nature, characteristics, and functionality of the goods.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to consumers who, at the time of contract conclusion, do not belong to a member state of the European Union and whose sole residence and delivery address at the time of contract conclusion are located outside the European Union.

General Notes

  1. Please avoid damaging or contaminating the goods. Please return the goods in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
  2. Please do not send returns with postage due.
  3. Please note that the above points (1-2) are not a prerequisite for effectively exercising your right of withdrawal.
